"Fortress OS" refers to the AI-powered business operating system software developed and operated by Roofing USA, including all agents, automation workflows, dashboards, and associated services.
"User" refers to any individual or entity that accesses or uses Fortress OS.
"Company" refers to Roofing USA and its affiliates, officers, employees, and agents.
Subject to the terms of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use Fortress OS solely for your internal business operations. This license does not include the right to sublicense, resell, or distribute the software to third parties.

You agree not to:
Fortress OS collects and processes business operational data including customer information, work order details, financial records, and communications logs. All data handling is governed by our Privacy Policy, which is incorporated into this Agreement by reference.
You represent that you have obtained all necessary consents and authorizations to provide customer data to Fortress OS for processing.
Fortress OS integrates with third-party services including Centerpoint Connect, QuickBooks Online, Twilio, Gmail, Slack, DocuSign, and others. Your use of those services is governed by their respective terms of service. The Company is not responsible for the availability, accuracy, or actions of third-party providers.
Fortress OS uses artificial intelligence to generate recommendations, draft communications, and automate decisions. All AI-generated outputs are subject to human review before any high-risk action is taken, as defined by the system's Risk Tier policy. The Company does not guarantee the accuracy of AI outputs and is not liable for decisions made in reliance on such outputs without appropriate human oversight.
All rights, title, and interest in Fortress OS — including source code, agent logic, workflows, and documentation — remain the exclusive property of the Company. Nothing in this Agreement transfers any ownership rights to you.
You agree to keep confidential any non-public information about Fortress OS, including system architecture, agent configurations, and business logic, and not to disclose such information to third parties without prior written consent.
FORTRESS OS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF FORTRESS OS, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU, IF ANY, FOR ACCESS TO FORTRESS OS IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of Fortress OS, your violation of this Agreement, or your infringement of any third-party rights.
This Agreement is effective until terminated. The Company may terminate your access to Fortress OS at any time, with or without cause, upon notice. Upon termination, all licenses granted herein immediately cease, and you must discontinue use of the software.
This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Charleston County, South Carolina.
The Company reserves the right to modify this Agreement at any time. Continued use of Fortress OS after changes are posted constitutes acceptance of the revised terms.
